General Terms & Conditions of Service (Weddings)
In the following terms & conditions ‘’the photographer’’ shall mean Tom Willers trading as Pandora Photography Portsmouth. ‘’The client’’ shall be defined as the person(s) who are responsible for payment of the photography services. The terms & conditions cannot be varied in any way by the client unless such conditions are expressly agreed by the photographer in writing.

Copyright
i . The copyright Designs and Patents Acts assigns the copyright of the images to the photographer.
Display
i. The client(s) hereby allows the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.
Creative License, Coverage and Reproduction
i. Photographs taken during the course of the event will be at the discretion of the photographer although every effort will be made to comply with the client(s) requirements.
ii. Special requests are not binding instruction, although every effort will be made to comply with the client(s) wishes. The photographer will do their best to honour the requested photographs but does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangements due to changes in weather and the availability and willingness of subjects.
iii. For bookings involving a church ceremony or at certain venues, the photographer’s movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed or limited views.
iv. Due to a variety of lighting conditions (including artificial and natural light) and the limitations of digital sensors, some colours may alter throughout the set of photographs.
v. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to a technical failure.
Terms of Payment
i. A non-refundable deposit of £50.00 will confirm your booking, and full acceptance of these terms & conditions as published on the photographer’s website. The deposit will be deducted from the cost of the clients chosen package.
ii. Payment in full of the remaining balance is due two weeks prior to the day of the wedding and should be paid in cash or bank transfer.
iii. Additional services ordered must be paid for at the time of ordering.
iv. Titles to all goods will remain with the photographer until the final balance has been settled and all monies received.
Force Majeure
i. In the very unlikely event of cancellation by the photographer or of total photographic failure liability shall be limited to a full refund of any fees paid.
ii. The photographer will endeavour to put the client(s) in contact with another photographer in the event that they are unable to attend on the wedding date due to any cause beyond their control (to include but are not limited to: sudden illness, injury, victim of crime, flooding, traffic conditions, vehicle breakdown etc).
Digital Negative Files
i. All digital negatives (computer files) remain the property of the photographer. All digital wedding packages include a copy of the raw digital images which the client may use for their own non-commercial use.
ii. Should the digital negative files be lost, damaged or destroyed for reasons beyond the photographers control, the photographers liability shall be limited to a full refund of any deposits or fees paid, but shall not include a refund for any goods already received.
On the day
i. The photographer will be the sole professional (still) photographer at the venues specified by the client. The photographer does however positively encourage family, friends and other guests to take photographs throughout the day.
ii. The photographer will stay to photograph the first dance (full-day package only) and any photography following this time will be at the discretion of the photographer unless otherwise agreed in writing beforehand.
iii. The photographer will not take photographs during the wedding breakfast and will use this time to take a break. A meal is not a necessary requirement; however, one would be greatly appreciated.
Personal Accident
i. Any direction issued to the client(s), their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during the photoshoot.
Cancellation
i. If the client(s) should have to cancel a booking the following cancellation fees will apply:
a. Cancellation from the date of booking up until twelve weeks before the wedding date; the photographer reserves the right to retain the non-refundable booking fee of £50.00.
b. Cancellation within twelve weeks of the wedding day; the photographer reserves the right to charge the full amount as agreed between the photographer and the client at the time of booking. The client(s) are hereby advised to take out an appropriate wedding insurance policy to cover any expenses incurred in the event of a cancellation.
ii. All cancellations must be made in writing to the photographer.
Delivery
i. The photographer will endeavour to deliver digital negatives and the edited photographs withing 4-6 weeks of the wedding day. However timescales may vary during peak times.
